TRADE REWARDS 2017 PROMOTION
Terms and Conditions:
This promotion (the "Promotion") is brought to you by Brake and Transmission NZ Ltd ("BNT"), Truck & Trailer Parts ("TATP") and Autolign ("ATL"). These Terms & Conditions ("Terms") set out the rules of participation in the Promotion. By entering the Promotion, you guarantee that you have the authority to accept these Terms and you agree to be bound by the Terms. In the event of any dispute regarding the Terms or the conduct, results and all other matters relating to the Promotion, BNT/TATP/ATL's decision will be final and binding and no correspondence or discussion will be entered into. The Promotion commences at 00.01 NZT on 1st May 2017 and closes at 23.59 NZT on 31st July 2017 ("Promotion Period")
You must be at least 18 (eighteen) years of age and a legal resident of New Zealand in order to be eligible to enter the Promotion ("Qualifying Entrants"). Employees of BNT/TATP/ATL and/or their immediate family and agencies associated with the Promotion are not eligible to enter the Promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. The Promotion is only open to Qualifying Entrants who, on the date of entry, are legal residents of New Zealand and is void in any other country. BNT/TATP/ATL shall not be taken to make any representations, express or implied, as to the lawfulness of any individual's participation, or as to any other aspect of the Promotion. BNT/TATP/ATL reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age, place of residence and employment) and to disqualify any entrant who submits an entry that is not in accordance with these Terms. Errors and omissions may be accepted at BNT/TATP/ATL's discretion. Failure by BNT/TATP/ATL to enforce any of its rights at any stage does not constitute a waiver of those rights. If there is a dispute as to the identity of an entrant, BNT/TATP/ATL reserves the right, in its sole discretion, to determine the identity of the entrant.
Rival automotive parts importing and competing distributor companies are excluded from the promotion.
Rules of Entry
The Promotion must be entered as per any instructions set out for the Promotion on the Trade Rewards 2017 promotional material in conjunction with these Terms. The promotion is open to BNT/TATP/ATL current Trade Accounts ("Account"); An Account must be paid in full to redeem a reward. Qualifying Entrants must complete the registration form provided by BNT/TATP/ATL, unless automatically entered by BNT/TATP/ATL into the Trade Rewards 2017 promotion to enter their Account.
One registration per Account only, however multiple Qualifying Entrants may register to receive notifications, point's updates, etc. for an Account. Where there are Parent and Child accounts, registrations shall be against child accounts.
All registrations are subject to acceptance by BNT/TATP/ATL. The Entrant agrees that BNT/TATP/ATL shall not be liable as a result of any refusal or failure to accept a registration and no compensation shall be payable to any person in consequence of such action.
Points per Trade Account are earnt within the brands participating in that companies "Participating Brands".
Participating Brands for BNT/TATP Accounts:
BNT/TATP's participating brands including BNT, Fuchs Lubricants (NZ) Ltd, UCI-FRAMGROUP NZ Ltd, JAS Oceania NZ Ltd, Australian Clutch Services, Dayco Australia PTY Ltd, Fargo International Ltd, Donaldson Australasia PTY Ltd, Tridon NZ Ltd, CRC Industries NZ Ltd, HCB Technologies, Hella NZ Ltd, FMP Group Australia PTY Ltd, George Stock & Company, NZ Gaskets Ltd, Redranger, Narva New Zealand Ltd, Hobeca Trading Company Ltd, Bearing Wholesalers, represented by but not limited to brand logos as per supporting promotional materials.
Participating Brands for ATL Accounts:
ATL's participating brands including Monroe, Nolathane and Whiteline represented by but not limited to brand logos as per supporting promotional materials.
BNT/TATP/ATL reserves the right to add brands during the Promotion Period. BNT/TATP/ATL may make bonus entry offers for selected brands or products during the promotion.
During the promotion period, Account's earn 1 point for every $100 + GST spent (accumulated), less credits, per participating brand on their BNT/TATP/ATL Trade Account. Fuchs spend applies to 20 litre product only, some brands only apply to selected lines. Not in conjunction with other major promotions. The points are earnt within each brand of purchase. E.g. $100 in DAYCO = 1 Point, $75 in DONALDSON + $25 in TRIDON = 0 Points
Points will be recorded in an Account's point's record for purchases by the Account, of qualifying products from a Participating Brand. Points may also be recorded in an Account's point's record in relation to promotional offers.
BNT/TATP/ATL and the participating companies will from time to time determine which goods or services are qualifying goods and services, the number of points that will be recorded in a Account's point's record for such purchases and any terms and conditions that apply to the collection of points.
BNT/TATP/ATL will from time to time forward a Points Summary to selected Accounts setting out the points recorded and deducted during the promotion period and the closing points balance.
Disputes about the Points Summary must be notified to BNT/TATP/ATL within one week of receiving the points summary. The Points Summary will otherwise be taken to be correct and binding on the Account. BNT/TATP/ATL's decision on any such dispute is final and binding.
Deduction of points
The number of points published by BNT/TATP/ATL for redemption of a reward claimed will be deducted from the point's balance of the Account's point's record. BNT/TATP/ATL may also deduct from the points balance in an Account's points record:
any points recorded in error (including where points have been recorded as a result of an Account being involved in fraudulent activities or where points have been recorded in an Account's points record but there has been no corresponding purchase of qualifying goods and/or services); and any points relating to a transaction which is cancelled or where a credit is given; and any points which are not used by an Account to claim a reward within the Promotion Period. These will expire and be deducted from the points balance in an Account's point's record. All points will be removed after four (4) days following the close of the promotion.
Claiming a reward
An Account who has sufficient points in his or her point's record may request a reward from the then current collection of rewards made available by BNT/TATP/ATL. Requests must be made by the Registered Entrant personally, in a way specified by BNT/TATP/ATL from time to time. The number of points required to claim a reward maybe subject to change without notice. All rewards are subject to availability. Rewards will, at BNT/TATP/ATL's option, be posted or delivered to the current address of the Account shown in BNT/TATP/ATL's records or made available for collection at a location notified to the Account. If BNT/TATP/ATL agrees to replace a lost or stolen reward, the Registered Entrant shall comply with such conditions as BNT/TATP/ATL imposes.
All rewards are subject to such other terms and conditions as are mentioned at the BNT/TATP/ATL website, or other confirmation, or in any other terms and conditions relating to the reward determined by the reward provider.
All Rewards are subject to availability, non-transferable and non-exchangeable.
BNT/TATP/ATL make no representation or warranty in relation to Rewards provided and to the fullest extent permitted by law we shall have no liability to you in relation to any Reward, its fitness for purposes, merchantability or otherwise. Any warranty issues may be directed to the product manufacturer or their appointed agent.
Rewards are available in limited numbers and are available on a first in basis; any points not redeemed may not be transferred for cash or other items.
An Account cannot claim a reward using Points recorded in the Account's point record that the Account knows, or ought to know, have been recorded in error or as a result of fraud. If, in BNT/TATP/ATL's opinion, an Account claims a reward using Points that the Entrant knew, or ought to have known, were recorded against the Account's points record in error or as a result of fraud, the Entrant will promptly return the reward to BNT/TATP/ATL in its original condition or will promptly reimburse BNT/TATP/ATL for the cost of the reward.
BNT/TATP/ATL may suspend an Account's ability to claim a reward, without notice and for such period of time as BNT/TATP/ATL considers appropriate, if BNT/TATP/ATL considers on reasonable grounds that points may have been collected by that Account as a result of fraud by that Account in relation to a Participating Brand.
Travel Packages for BNT/TATP Accounts
Upon your first redemption you are given 1 entry into the $2,500 travel prize draw. A total of 9 travel prizes are available, maximum of 1 entry per account. Each $2,500 travel prize is represented by a Tier 1 Participating Brand, Australian Clutch Services, Fuchs Lubricants, Dayco, Donaldson Filtration, Fram, Xcell, KYB, CRC, and Hella.
Travel Package for ATL Accounts
Upon your first redemption you are given 1 entry into the $2,500 travel prize draws. A total of 3 travel prizes are available, maximum of 1 entry per account. The $2,500 travel prizes are represented by Tier 1 Participating Brand, Monroe.
12 winners will be drawn from all eligible entries validly submitted ("Winners"). The Winners will be drawn electronically. The draw will take place at BNT, 21-27 Omega Street, Rosedale, Auckland, New Zealand at 9:00 am NZT on 9th August 2017. The decision by BNT/TATP/ATL as to the Winner shall be final.
All travel prizes are subject to such other terms and conditions as are mentioned on the reward voucher or other confirmation, or in any other terms and conditions relating to the reward determined by the reward provider including on any ticket for airline travel. It is the Winner's responsibility to satisfy any terms and conditions imposed by an airline or other reward provider including advance booking requirements and any restrictions on and/or fees payable in respect of the cancellation or alteration of tickets.

Both Tier 1 and Tier 2 sponsors contribute to this prize.
For every 1 point earnt, an Account will receive 1 entry into the major prize draw. There are an unlimited amount of entries available per account.
The Winners will be notified via email and/or telephone within 5 [five] working days of the draw using the contact details provided at the time of entering the Promotion and also published in the September edition of the Trade Supporter and The Hub and the October edition of the Suspension Leader publications.
The Prize includes nothing other than that expressly stated to be included as part of the Prize. Proof of age may be required before the Prize can be given. BNT/TATP/ATL reserves the right to substitute the prize for another prize of equal or greater value, should the need reasonably arise. Allocation of the Prize shall be at BNT/TATP/ATL's sole discretion. The Prize shall be subject to applicable Terms & Conditions which apply to the possession and use of the Prize. The Prize cannot be exchanged for cash or account credit. The Prize is non-transferable and subject to availability. If a Winner is unable to utilise the Prize no cash alternative will be provided. All other expenses associated with redeeming the Prize (including but not limited to, food, travel, flights, accommodation other than as provided for under these Terms), travel insurance and any other incidental costs and expenses shall be borne by and are the responsibility of the Winner. Vehicle insurance, Fuel, RUC, WOF, Servicing costs, etc. shall be the responsibility of the winner once transfer of vehicle ownership is complete. The winner must hold a valid New Zealand Driver License to register the vehicle.
BNT/TATP/ATL shall not be liable for any failure to comply with their obligations where such failure is caused by events outside their reasonable control, including but not limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots or any other circumstances amounting to force majeure. BNT/TATP/ATL accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by the Winner as a result of entering or participating in the Promotion or accepting the Prize.
The Winner will be drawn from all eligible entries validly submitted ("Winners"). The Winner be be drawn electronically. The draw will take place at BNT, 21-27 Omega Street, Rosedale, Auckland, New Zealand at 9:00am NZT on 9th August 2017. The decision by BNT/TATP/ATL as to the winner shall be final.
In the event that a Winner cannot be contacted; fails to confirm acceptance of the Prize within 5 (five) working days of receiving notification; or is ineligible for entry into the Promotion then BNT/TATP/ATL reserves the right to substitute them with another Qualifying Entrant of its choice. In the event that a Prize is unclaimed, the draw will take place at BNT, 21-27 Omega Street, Rosedale, Auckland, New Zealand at 9:00 am NZT on 11th August 2017, subject to any written directions from a regulatory authority. The Winner will be notified by email within 2 [two] working days of the draw. BNT/TATP/ATL takes no responsibility for incorrect contact details provided by the Winner.
Total prize value per Winner is NZD 2,500 RRP for Travel and $33,990 for the major prize. Any valuation of the Prize shall be based on information available to BNT/TATP/ATL as at the date of the Promotion and the value of the Prize may be disclosed by BNT/TATP/ATL where required by law for tax purposes. The Winner is solely liable for reporting and paying any and all applicable taxes including but not limited to, personal tax, service tax and other entertainment tax due as a result of the Prize and BNT/TATP/ATL accepts no responsibility for any tax implications arising as a result of the Prize.
BNT/TATP/ATL collect and use the Qualifying Entrant's personal information (the "Data") in order to conduct the Promotion and may, for this purpose, disclose or transmit such information to third parties rendering services in relation to the Promotion. By entering the Promotion and providing the Data the Qualifying Entrant authorises BNT/TATP/ATL to collect and process the Data in this manner. In entering the promotion, the Qualifying Entrant authorises BNT/TATP/ATL to retain and use the Data and to transmit the Data to and/or to share it with: BNT/TATP/ATL branches, authorised agents, BNT/TATP/ATL's other companies and/or brands, anyone to whom BNT/TATP/ATL transfers their rights and duties, third party companies offering related services (including, for example, car rental, hotels, limousines, transfers, ancillary services), governments and government agencies, credit card and other payment card companies, and airlines or providers of such related services. BNT/TATP/ATL may also retain the Data for other direct marketing and BNT/TATP/ATL undertakes to collect, process, store, save and transfer the Data in compliance with relevant data protection legislation in force from time to time. In processing the Data BNT/TATP/ATL may transfer it to countries which may not afford the same level of protection. The Winners agree to participate in such reasonable publicity as may be requested by BNT/TATP/ATL. The Winners agree to the publication of their respective name, business name and town/region in connection with the Promotion. If the Qualifying Entrant would like to know what Data BNT/TATP/ATL is holding about them and/or correct the Data that BNT/TATP/ATL hold about them they should contact BNT Head Office.
BNT/TATP/ATL will not be liable to perform any of its obligations under these Terms where it is unable to do so as a result of circumstances beyond its reasonable control including but not limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots or any other circumstances amounting to force majeure. BNT/TATP/ATL accepts no liability (and excludes all liability) for any loss of profit, business, contracts, revenues or anticipated savings or for special, direct, indirect or consequential loss of any nature howsoever arising. BNT/TATP/ATL accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by the Winner or where applicable the guest as a result of entering or participating in the Promotion or accepting the Prize. This exclusion does not include any liability for death or personal injury caused solely by the negligence of BNT/TATP/ATL. Participants enter the Promotion at their own risk and agree to indemnify BNT/TATP/ATL against all costs, losses, damages, expenses and liabilities (including for loss of reputation and goodwill and professional advisors' fees) and any claim arising from a participants own actions in any way in connection with the Promotion or a breach of a participants obligations hereunder.
Participation in the Promotion does not confer on the entrant any rights in or over any intellectual property arising in connection with the Promotion. Any Terms which are held to be invalid in any jurisdiction shall whenever allowed by the context be deemed to be replaced by such valid and enforceable Terms & Conditions whose contents are as close as permissible to those of the invalid or unenforceable Terms. BNT/TATP/ATL reserves the right to modify or vary the Promotion and/or these Terms at any time. These Terms shall be governed by and construed in accordance with laws of New Zealand, and as applicable Australia, and the New Zealand courts shall have exclusive jurisdiction in relation to any disputes arising.
